March, 2008: But that won't replace their 36-year-old mom, Eufemia Martinez, who had her stomach stapled down to the size of two tablespoons and her intestines rerouted at North General Hospital in Harlem.
Asked at trial what he missed most since his mother died, Julio Martinez, who was 10 years old when she passed away, said, "My mom's hugs," as reported in the NY Post.
The Bronx mom stood 5-foot-6 and weighed 230 pounds. But the doctor "changed the records" to make her height 5-foot-3 so she could be considered morbidly obese to medically require the surgery, said attorney Jeffrey Lichtman.
"12 Million Dollar Award Against Nassau County Upheld on Appeal"
January, 2008: The Appellate Division of the Supreme Court, Second Department, affirmed a $12,155,973.36 judgment against Nassau County and the driver of a car involved in a January, 13, 1995 auto accident. The accident occured at "dead man's curve: in Farmingdale, the site of many previous accidents, some involving fatalities.
In two of the prior accidents, Nassau County had been held liable for the defective design of the road.
The plaintiff, Merryl Kihl, now a 37-year-old mother of one, was a passenger in the car and was severely injured in the one car accident. As the result of her injuries, she underwent and will be compelled in the future to undergo numerous further surgeries. It was also established at trial that for the balance of her lifetime, she would be the subject of unremitting pain and suffering only relieved by morphine based painkillers.
The judgment is one of the largest awards to be affirmed against the County.

On March 11, 1999, the New York Law Journal reported that a federal appeals court affirmed a jury verdict holding that the manufacturer of a meat grinder, which had had safety devices removed, was partly responsible for injuries sustained by a Bronx butcher.
The worker, 17-year-old Luis Liriano, who was represented by New York personal injury law firm Trolman, Glaser & Lichtman, had to have his hand amputated. A Bronx jury found both the manufacturer and Liriano's employer, Super Associated, liable for his injuries and awarded the young man $1 million.
In an opinion for the U.S. Court of Appeals for the Second Circuit, Judge Guido Calebresi, wrote that the manufacturer should have added more warning labels to its machine to indicate to the user of the grinder that operating it without protective guards is dangerous.
The Journal quoted Jeffrey Lichtman, one of Liriano's lawyers, who expressed relief that his client had finally been vindicated. He said the opinion sent an important message to manufacturers about the need for comprehensive safety warnings in the event that their machinery is altered in ways that make them hazardous to operators.

On November 23, 1999, the Staten Island Advance published a front-page story about a $7.7 million jury verdict for a teenage girl who had been severely burned in an apartment owned by the New York City Housing Authority.
Kristal Pereira, who was represented by Michael Madonna of the New York personal injury law firm Trolman, Glaser & Lichtman, was a four-year-old when she sustained second- and third-degree burns on her head, ear, wrist, and shoulder after coming into contact with an exposed steam pipe in the family's bathroom.
The newspaper reported that the girl would use the money for reconstructive surgery for her damaged ear and other scars.
"Trolman, Glaser & Lichtman partner applauds jury verdict for woman hit by subway"
Jeffrey A. Lichtman, partner with the personal injury law firm Trolman, Glaser & Lichtman, published a letter in June 25, 2002, edition of The New York Times criticizing a Times writer for arguing that a woman injured after being hit by a subway was responsible for her lifelong injuries.
Lichtman's letter applauded the jury that found the New York City Transit Authority to be liable for the public transport accident. "It doesn't matter why the victim was there; the driver had an obligation to stop," wrote Lichtman, president of the New York State Trial Lawyers Association.
Lichtman added that city agencies should seek to limit the cost of negligence lawsuits by "having their employees act with care, not take away citizens' rights."
